    Do you really think that part e, ‘death penalty’ and not “New York State” is really empty / no articles?

    death penalty and not New York State, is not giving me any hits, no matter where I place the parentheses?
    I tried it without the “and” (death penalty, not NYS), and received 4540 hits??

    Yes, what you discovered it that it is an error in some databases whenever you put two connectors together. s AND NOT n makes perfect sense both verbally and logically (math) but the database does not like it. If you read the HELP screen, it tells you that. Try the following:
    s ~n (omit the AND) and try ~n /\ s (commutative).

    Yep, I tried the s(death penalty), ~( NYS) on the academic search premier database, and received 4,540 hits.
    When I tried the ~n (not NYS) ^ (and) s (death penalty), when typed in as such, it does not give me any hits either.
